Section One:

1. Material on this website is the property of ITOH (founded by Trish Ladd and Brett Lynam) with some joint ownership exceptions. Any content posted here that has been created by you is held in joint custody. By posting your content here, it becomes part of the world of Myrdinn and will not be removed unless ITOH determines to do so for its own benefit and players. Unless noted otherwise, all material on this website, including but not limited to images, audio, and text material (collectively the “Material”), is protected by copyright, owned or controlled by ITOH. UNAUTHORIZED COPYING, REPRODUCTION, REPUBLISHING, UPLOADING, DOWNLOADING, POSTING, TRANSMITTING OR DUPLICATING OF ANY OF THE MATERIAL FOR PURPOSES OTHER THAN TO OPERATIONS OF THE GAME IS PROHIBITED. The exception is content that YOU contributed for ITOH’s use.

2. Your use of this site constitutes your agreement to abide by these Terms of Use. In The Time of Heroes as well as their agents and assignees, as applicable reserve the right, in their sole discretion, to modify, alter or otherwise update these Terms of Use at any time and you agree to be bound by such modifications, alterations or updates. Notification of updates to these Terms of Use shall be provided to members. You agree to review these Terms of Use upon receipt of this update notification.

3. In The Time of Heroes hereby grants you a personal, non-exclusive, non-assignable and non-transferable license to use and display, for home, noncommercial and personal use only, one copy of any Material and/or software that you may download from this site, including, but not limited to, any files, codes, audio or images incorporated in or generated by the software (collectively the “Downloaded Material”) provided, however, that you must maintain all copyright and other notices contained in such Downloaded Material. You acknowledge and agree that you may not sublicense, assign or otherwise transfer this license or the Downloaded Material and that no title to the Downloaded Material has been or will be transferred to you from In The Time of Heroes or anyone else. You also agree that you will not alter, disassemble, decompile, reverse engineer or otherwise modify the Downloaded Material without prior written authorization from In The Time of Heroes or the original licensee of such third party Downloaded Material provided on In The Time of Heroes websites.

4. All “in Game” material created for the use of, and used by the players and staff of In The Time of Heroes including but not limited to: Cities, Terrain Features, Maps, Non-Player Characters, History and Background and “out of game” content such as, but not limited to Websites related to In The Time of Heroes, and the Content on said websites are the sole property of In The Time of Heroes and shall remain so even if the originator of said material disassociates themselves from In The Time of Heroes.

4. In The Time of Heroes is not necessarily affiliated with sites that may be linked to this site and is not responsible for their content (“Linked Sites”). The Linked Sites are for your convenience only and you access them at your own risk.

DISCLAIMERS AND LIMITATIONS ON LIABILITY

In The Time of Heroes is not responsible or liable for any infections or contamination of your system or delays, inaccuracies, errors, or omissions arising out of your use of this site or with respect to the Material contained on this site. This site and all Materials contained on it are distributed and transmitted “as is” without warranties of any kind, either express or implied, including, without limitation, warranties of title or implied warranties of merchantability or fitness for a particular purpose. The entire risk as to the quality, accuracy, adequacy, completeness, correctness and validity of any material rests with you. In The Time of Heroes is not responsible for any special, indirect, incidental, or consequential damages that may result from the use of, or the inability to use, the materials contained on this site whether the material is provided or otherwise supplied by In The Time of Heroes or anyone else. Notwithstanding the foregoing, in no event shall In The Time of Heroes’s total liability to you for any and all claims, damages, losses, and causes of action (whether in contract or tort or otherwise) exceed the amount paid by you, if any, for accessing this site.

RULES FOR POSTING
6. If you have been granted permission to post, we’ve given you trust that you will not abuse it. We have the right to alter and remove any offensive, malicious or abusive content – such as the posting of links, or other code that may be added to a post’s content with or without intent of the poster. You shall not upload, transmit, distribute or otherwise publish through such posts with any content which is in violation of the Acceptable Use Policy.

7. This site is controlled and operated by In The Time of Heroes from its agents in the United States of America. In The Time of Heroes makes no representations that materials in this site are appropriate or available for use in other locations. Those who choose to access this site from other locations do so at their own risk and are responsible for compliance with any and all local laws, if and to the extent local laws are applicable. No software from this site may be downloaded, exported or reexported into (or to a national or resident of) any countries that are subject to U.S. export restrictions.

8. The management of In The Time of Heroes reserves the right to refuse service to anyone. The right to participate in In The Time of Heroes may be revoked by game management whenever they deem it necessary.

Section Two:

LEGAL INFORMATION
Permission to copy, modify and distribute the files collectively known as 5thsrd.org is granted solely through the use of the Open Gaming License, Version 1.0a.

This material is being released using the Open Gaming License Version 1.0a and you should read and understand the terms of that license before using this material.

The text of the Open Gaming License itself is not Open Game Content. Instructions on using the License are provided within the License itself.

All of the rest of 5thsrd.org is Open Game Content as described in Section 1(d) of the License.

Section Three:

In the Time of Heroes (ITOH) for its purposes has created a unique game environment, the world known as Myrddin. To complete this fantasy setting there have been multiple contributors of various types of information. This information includes (but is not exclusive to) fantasy lands, spells, unique prestige classes, history, legends and deities. All contributors to this setting are allowed to keep certain rights to this material such as for their personal use, but by contribution to the world setting agree to grant use, without future privilege of revocation of said material to ITOH.
